USCIS Issues Clarifying Guidance on O-1B Visa Eligibility for Extraordinary Ability in Arts and Motion Picture Industry

The US Citizenship and Immigration Services has issued policy guidance on the eligibility criteria for the O-1B nonimmigrant visa classification for individuals with extraordinary ability in the arts and extraordinary achievement in the motion picture or television industry. The guidance includes an appendix with examples of evidence that may satisfy the O-1B evidentiary criteria, as well as considerations relevant to evaluating such evidence. The guidance is aimed at providing adjudicators with predictable and transparent application of the O-1B evidentiary requirements, leading to consistent decisions and improvements in efficiency. The guidance is effective immediately and supersedes any related prior guidance on the topic.
