New Alien Registration Requirement: Key Info for Canadians and Parents of Children Turning 14 in the U.S.

Recent changes to the Alien Registration process have raised questions—particularly among Canadian nationals and families with children turning 14 while in the United States. Here’s what you need to know based on recent guidance from U.S. immigration officials and Customs and Border Protection (CBP).

Canadian Visitors Staying Over 30 Days

There’s been discussion in the legal community suggesting Canadian visitors staying more than 30 days should request an I-94 form at the time of entry into the U.S. However, leadership at the Buffalo CBP Field Office has advised against this. While the intention behind requesting an I-94 is to potentially avoid registration later, doing so may create logistical challenges at the border.

According to USCIS guidance, Canadians who remain in the U.S. for more than 30 days can complete the Alien Registration process online. Importantly, they are not required to undergo biometrics. Therefore, Canadians entering the U.S. by land should not be directed to request I-94s, as it’s not operationally feasible for CBP to issue them for every traveler.

What About Children Turning 14 in the U.S.?

For families, another common concern relates to children who turn 14 while physically present in the United States. The Alien Registration requirements apply to anyone age 14 or older who remains in the U.S. for more than 30 days. Parents should ensure their child completes registration within 30 days of their 14th birthday if they meet the stay requirement. The registration process is completed online, with no biometrics required.

CBP leadership has indicated that they’re seeking additional clarification from headquarters. Updates will likely follow in the coming weeks. In the meantime, AILA members and legal practitioners are encouraged to rely on the current USCIS guidance and avoid advising Canadian clients to request I-94s unless absolutely necessary.
