On March 31, 2025, the United States District Court for the Northern District of California ordered a postponement of the vacatur (published February 3, 2025) and the termination (published February 5, 2025) of the 2023 TPS designation for Venezuela.
As a result of the District Court’s order, TPS for Venezuela remains in effect until DHS obtains relief from that order. Additionally, the validity of EADs with a Card Expires date of September 10, 2025; April 2, 2025; March 10, 2024; or September 9, 2022, issued under the Venezuela TPS designations, are extended through April 2, 2026, pending further litigation. Employers should check the TPS webpage regularly for updates.
Creating an E-Verify Case
- After a new employee completes Form I-9, Employment Eligibility Verification, create a case in E-Verify for this employee.
- Enter the EAD document number you used on Form I-9, as well as the automatically extended date of April 2, 2026.
- You must reverify these employees on Form I-9 before they start work on April 3, 2026.
