米国で永住権を取得しようとしている外国人医師には、いくつかのオプションがあります。 書類提出などのハードルは高いですが、グリーンカードを取得する価値は十分にあります。 永住権を取得するため外国人医師が持つ選択肢を見てみましょう。

 

1つめの方法は、雇用主にスポンサーになってもらい労働証明書を通じて永住権を申請することです。 このプロセスの間、雇用主は米国労働省（DOL）に、申請者である外国人医師が行う仕事を引き受ける資格があり、また準備ができており、申請者以外に適任な米国の医師が他にいないことを示す必要があります。そのため雇用主は、求人サイトで申請者と同じスキルを持つ医者を募集し、提出された申請書を確認し特定の方法に従って書類作成を行う必要があります。

次のステップとして、雇用主は労働証明書申請書をDOLに提出し、証明されるとUSCISにI-140請願書を提出します。 請願書が承認された後、ビザ番号が利用可能になるまで待機期間が生じる可能性があります。 すぐに番号が利用できる場合、医師とその家族は永住者になるためにステータス調整を行うことができます。米国外の場合は海外の米国領事館または大使館で手続きを行うことができます。

 

他の方法として、外国人医師は労働証明書プロセスの回避ができる国益免除（NIW）を申請できる可能性があります。NIWは医学的に十分なサービスを受けていない地域（MUA）または退役軍人省の施設で最低5年間働くことを意図している医師にとっての選択肢になるかもしれません。 この申請者はスポンサーがいる必要はありません。承認を受けた医師は、医療サービスが十分に行き届いていない地域で5年間勤務し、5年間の勤務を終えてから120日以内にW-2フォームなどの5年間の勤務文書をUSCISへ提出する必要があります。 受領後、USCISは指紋採取の予約を進め、そのあとに面接を行います。

 

また、別のオプションとして、EB-1A請願書を提出することにより、永住権を取得できる場合があります。 申請者は自身の分野で傑出した存在として認められるようになっている証拠提出が必要です。注目すべき賞の文書化、出版物、その他の科学的貢献の証拠提出によって申請条件を裏付ける必要があります。
