・国土安全保障省は、22の新しい研究分野がStudent and Exchange Visitor Program（SEVP）を通じてSTEMオプショナルプラクティカルトレーニング（OPT）プログラムに含まれるようになったと発表しました。 このプログラムでは、特定のSTEM分野で学士号、修士号、博士号を取得しているF-1ビザ学生が学位を取得した後、OPTを完了するために最大36か月間米国に滞在することができます。 新しい研究分野に関する情報は、今後学校と学生に通知されます。 追加された研究分野は、主に新しい分野であり米国の経済成長と技術競争力をサポートする人材を引き付ける上で重要です。

・DHSは、O-1Aビザ取得を満たす基準に関するポリシーマニュアルの更新を発行しています。O-1Aビザは、科学、ビジネス、教育、陸上競技の分野での能力を発揮する人が利用できます。 今回のアップデートでは、科学、技術、工学、数学（STEM）の分野でありPHD保有者等で、適格性をどのように決定するかを明確にしています。
・O-1Aビザ基準を満たす可能性のある例を提供し、STEM分野の高度な技術的性質と提出が必要な複雑な証拠に焦点を当てて、証拠の評価に関連する考慮事項について説明しています。
・ビザ更新や新規申請者が特定の基準が彼らの職業に適用されない場合、持続的な称賛と基準に匹敵する重要性の証拠を提出できる可能性があることも記しています。

・移民に関しては、USCISが、その分野で能力を発揮する移民に対して、national interest waivers (NIW)をどのように裁定するかについてのポリシーマニュアルの更新をしています。
・移民国籍法（INA）は、雇用主が能力があり高度な学位を持つ労働者に対して請願が提出できることを規定しています。 また国益のために仕事をしている移民は、雇用主なしで自分で請願することができます。
・USCISポリシーの更新では、STEM分野、起業家に対してNIWをどのように使用できるかは、政府や準政府機関からの手紙が重要な判断材料になります。この更新によって、USCISはより効率、効果的な判断を行うことできます。これらは不法移民制度を回復するためのバイデン政権の優先事項と一致しています。
