2022年5月4日より、米国国土安全保障省（DHS）は、特定の更新申請者の雇用許可、雇用許可文書（EAD）の期限切れに関連するDHS規制を修正すると発表しました。 最大180日の延長期間は、現在のEADに記載されている有効期限から最大540日に自動的に延長されます。

 

2019年までUSCISは不安定な財政状況にありケース処理の効率的な完了を損ないました。 コロナの影響で2020年にこの課題が悪化し雇用の凍結と窮状の脅威が労働力の減少と大幅な能力の低下につながりました。2021年USCISがこれらの財政的、また運用上の影響から回復する前にEADの申請や更新する人が劇的に増加しました。

 

その結果、フォームI-765の処理時間と180日間の自動延長期間では、ギャップのリスクを防止・軽減するのに十分な時間が確保されていないレベルまで増加しました。 一部の申請者は、自動延長期間がすでに満了しており、その結果、更新申請者は現在の雇用主との雇用を得ることができない・雇用を継続できない可能性があり、雇用主は代替労働者を急遽見つなければいけない可能性があります。従業員と雇用者の両方の困難を軽減するため、DHSは一時的な期間、フォームI-765更新申請者のEAD自動延長期間を直ちに実行することが不可欠であると判断しました。この一時的な対処によってUSCISは人員不足にも対処し、追加の効率を実装し最終的にEAD申請に対する処理時間を短縮することも可能です。

 

最大540日間の自動延長の対象は、以前の最大180日間の雇用許可とEAD有効期間の自動延長の対象となるEADカテゴリーにのみ適用されます。 USCISは一時規則の発効日とその後540日間（つまり5月4日から）に保留中のEAD更新申請がある適格な申請者に、最大360日の延長を提供します。（合計で最大540日の追加自動延長時間を提供、 2022年から2023年10月26日まで）
