外国人労働者を解雇する際の考慮事項 – NPZ 法律グループによるガイド


米国で外国人労働者を解雇する場合、雇用主は州・連邦移民法を考慮する必要があります。 以下の弊社のガイドでは、特定の非市民労働者を解雇する際に雇用主がしなければならないことを説明します。
H-1Bビザ、H-1B1ビザ、E-3ビザステータスの従業員を解雇する際の考慮事項
労働条件申請に関する労働省 (DOL) による規則と米国市民権移民局 (USCIS) の規則により、従業員の解雇は非常に困難になります。 また雇用主はUSCIS との間で解雇が正しく行われなかった場合、賃金未払いの責任を負う可能性があります。終了には、次のことが必要です。
• 解雇前、従業員への書面による通知
• USCIS への書面による通知 (請願書が USCIS に提出された場合のみ)
• 米国労働省に提出された労働条件申請書の撤回
雇用主が外国人従業員を解雇する場合、雇用主は居住国に戻るための交通費を提供する必要があるかもしれません。ただし通常、従業員は退職後 60 日間米国に滞在できます。この期間は別の雇用主を探すためにも使用できます。
O-1ビザステータスの従業員を解雇する際の考慮事項
終了には、次のことが必要です。
• USCISへの書面による通知
• 従業員が元の居住国に戻るための合理的な交通費を負担するという申し出

E-1ビザ、E-2ビザステータスの従業員を解雇する際の考慮事項
強制的な要件はありません。 ただし米国領事館へ従業員の契約 (雇用契約) が終了したことを通知することをお勧めします。
L-1ビザ、TNビザステータスの従業員を解雇する際の考慮事項
雇用を終了するための要件や推奨事項はないので、雇用主は通知を行ったり交通費を負担したりする積極的な義務はありません。
I-140ビザ請願撤回
外国人労働者の雇用が終了した後、雇用主は I-140 ビザ請願を撤回する必要はありません。請願の撤回は外国人労働者に悪影響を与える可能性があります。一般的には撤回する前に終了してから 180 日が経過するまで待つのが最善です。
“二重代表”に関する問題
雇用主と従業員が同じ弁護士また法律事務所によって代表される場合があります。状況によってはうまくいくかもしれませんが「利益相反」をもたらす場合もあります。したがって雇用主としては従業員の弁護士とは別の弁護士を雇うのが最善かもしれません。
