H-1Bビザ抽選登録初日は2019年4月1日、2019年４月５日まで登録サイトがあいているとのことですが、新規H-1Bビザ申請者はその前に会社情報などの初期事前登録が設けられ４月1日前に行える予定です。

H-1B ビザは、企業の従業員のために最も頻繁に得られる労働許可証で、専門職スキルを持つ外国人労働者を雇うことを希望としている米国雇用主が利用可能なビザです。

職業としての専門スキルを定義しており、米国の大学、もしくは外国の大学で学士号（もしくはそれ以上）を取得した人が申請対象です。 大学の専門分野が直結していなくても、仕事の経験年数によっては申請が可能です。

学士号を持つ外国人労働者のための65,000人の枠、米国の大学の修士号を持つ外国人労働者のための20,000人の枠を合わせ、計85,000人の枠が準備されています。この枠は、すでにH1-Bビザを持っていてビザを延長したり、取得した時と違う雇用主先で働く申請をする人は含まれていません。

近年、4月の申請が始まってすぐに85,000人の枠を超えた申請数が集まっているようです。4月申請期間以降、85,000人以上の申請提出があった場合、85,000人に対してすぐに抽選が始まり、抽選に漏れた方の書類は即返却するとのことです。

抽選は２段階を踏むことになっています。1回目は少なくとも学士号を持つ人、または同等の資格を持つ外国人労働者のための65,000人枠から抽選し、 ２回目は修士号を持つ外国人労働者のために20,000人枠から抽選します。

弊社でも、2019年 4 月1日申請スタートと同時に申請できるよう準備をしています。 万が一今年の抽選から漏れてしまった場合、新しい提出をするために2020年4月1日まで待つ必要があるため、新しく申請する人はさらに前から書類準備が当然のことながら必要です。個人の状況により、また現在違うビザを持っている場合も申請方法などが少なからず違ってくる可能性がありますので、申請方法に間違いがないよう、また早く申請が開始できるよう、ご相談も受け付けております。
