国務省(DOS)のビザ発行遅延解決策 – NPZ Law Group, P.C.

 

2021年7月9日、AILA(American Immigration Lawyers Association)と国務省(DOS)連絡委員会の間でCOVID-19によるビザの未処理と遅延についての会議がありました。 ポイントは次の通りです。

・非移民ビザ(NIV)と移民ビザ(IV)の発行状況:
COVID-19前と比較し、NIVの発行は80%減少し、IVの発行は70%減少しました。

・COVID-19による地域の渡航禁止令の撤回:
AILAは、地域のCOVID-19渡航禁止令を撤回することが、未処理分を減らし領事館の負担を軽減する上で効果をもたらすと主張しました。これにより、NIEプロセスが排除され、文書で認定されたケースを続行できるようになり、領事館のリソースが開かれます。 AILAは、バイデン大統領政権に対し、地域の渡航禁止令の代わりに、COVID-19検査、予防接種要件、検疫などの方法を組み込むよう要請しました。

・国益例外の処理におけるDOSとCBPの場所内の不一致:
AILAは、エリアによって、また裁判官によって、NIEの裁定にかなりの矛盾や違いがあると説明しました。したがって、NIEプロセスを標準化する必要があることを説明し、すべてのNIE要求が同じ条件のもとで処理されるようにしました。

・更新の米国側ビザ処理:
AILAは、州側の処理を再開する必要があり、DOSは州側の領事館職員を活用して人員配置の制約に対処し処理を再開できるようにする必要がある旨を説明しました。
COVID-19中に期限切れのビザを24か月自動的に延長します。

AILAは、DOSがNIVに24か月の自動延長を提供することがいかに重要であるかについて議論しました。

・不正リスクの低いケースのリモート処理とインタビュー免除の使用増加:
AILAは、面接免除の適格性を継続するよう求め、特に詐欺のリスクが低い場合、リモート処理のメリットを説明しました。

ビザ番号の紛失防止:
AILAは、DOSがより効率的にケースを処理し、2021年9月30日までに移民ビザ番号が失われるのを防ぐことができると述べました。これは特に21年度の移民多様化ビザ番号に当てはまります。
