In a major policy shift, the U.S. Department of Justice (DOJ) has announced that temporary immigration judges will no longer be required to have prior experience in immigration law. According to ABC News, this change follows the firing, resignation, or transfer of more than 100 immigration judges, raising concerns about the future of immigration adjudications.
The Executive Office for Immigration Review (EOIR), the DOJ agency overseeing immigration courts, stated that immigration law experience is “not always a strong predictor of success” and that professionals from other federal agencies could serve effectively. However, advocates warn that the removal of seasoned judges and appointment of individuals without immigration backgrounds may further complicate a system already facing a backlog of over 3.7 million pending cases.
