USCIS Revises Policy on J Nonimmigrant Exchange Visitor Visa Adjudications

The U.S. Citizenship and Immigration Services (USCIS) has issued an updated policy guidance on the J nonimmigrant exchange visitor visa. The update clarifies USCIS’s role in adjudicating waivers of the two-year foreign residence requirement and change-of-status requests. It also provides general information about the J visa classification, including USCIS’s role in adjudicating employment authorization applications for J-2 family members. The guidance further explains the INA § 212(e) foreign residence requirement and USCIS’s role in adjudicating waivers, notably for foreign medical graduates.
