USCIS Announces Extension of Biometrics Submission Suspension for Certain Form I-539 Applicants

USCIS has extended the suspension of biometrics submission requirement for certain Form I-539 applicants requesting an extension or change of nonimmigrant status until Sept. 30, 2023. The suspension applies to those seeking H-4, L-2, or E nonimmigrant status. Adjudications for these categories will proceed based on biographic information and background checks without capturing fingerprints and photographs. However, USCIS retains the discretion to require biometrics on a case-by-case basis. Applicants meeting the suspension criteria do not need to submit the $85 biometric services fee and will receive a refund if submitted separately. USCIS plans to establish a permanent biometrics exemption for all Form I-539 applicants in the future.
