H-1Bビザは、必要条件を満たす人に与えられます。
この条件は少なくとも米国機関で学士号を取得していること、大学を卒業し学士号の取得を条件にしている企業からオファーをもらっていることも含まれています。 

毎年提出できるH-1Bビザの申請の数には年間上限があります。2020年度の限界はすでに達しました。H-1Bビザを申請した場合は、申請の受諾または却下を受けることは必須ではありません。 ただし証拠要求（RFE）を受け取ることがあります。2019年には、75.4％のH-1Bビザが承認されました。 その中で約60％がRFEを受け取りました。この通知の意味を理解することは重要です。特に2019年、RFEを受けた者の約40％が撤回または却下されたという事実があるからです。 

H1-Bビザを申請して、証拠請求(REF)を受け取りました。これは何を意味しますか？ 

REFの申請は、H1-Bビザの申請者が全ての必須要素を満たしているかを証明するのに役立ちます。申請者は米国機関の学士号の所持を明らかにすること、また、すでに雇用主からのオファーをもらっていること、その職務が学士号取得を要求していることを証明する必要もあります。証拠を提出することは簡単に思えるかもしれませんが、特に「専門職」と見なすための証拠提出は一筋縄ではいきません。 USCIS (米国移民局) は、STEMでの仕事（科学、技術、工学、数学）を好む傾向があります。これは専門職と断言しやすいからだと思われます。 

申請者がREFを受けることは、それぞれ理由があり、もし申請者が通常とは違う仕事分野の上で申請をするのであれば、この理由を提出する必要があるかもしれません。

専門職には学士号が必要ですが 他の要件が必要になる場合もあります。 RFEは、仕事のオファーが実際「専門職」であるという主張を裏付ける証拠の作成を要求することができるのです。 

いくつかの共通するREFの内容は、以下の通りです。 

仕事は、専門職かどうか雇用主と従業員の関係は存在するのか、成り立っているかどうか従業員のために社内勤務は十分かどうか従業員は、社内で適切な地位を維持できるのかどうか授業員の為に、十分な仕事環境があるかどうか雇用主は、第三者の仕事場所に関する条件は満たしているのかどうか必要な手数料が支払われたかどうか 

REFを受け取った時は、必要とされる情報をすぐに提出することです。

そうでないと、あなたのステータスは危うくなります。すみやかに提出しましょう。
