2020年11月14日、ニューヨーク州東部地区連邦地方裁判所のニコラス・ジョージ・ガラウフィス裁判官は、
チャドF.ウルフ事務局長代理が署名した2020年7月28日の覚書に関する意見を発表しました。
2020年12月4日、ガラウフィス裁判官は、国土安全保障省（DHS）に対し11月14日の覚書を実行するため特定の措置を講じるよう要求しました。
その結果、2020年12月7日より、米国市民権移民局（USCIS）は次のように行います。
・2017年9月5日より前に有効な条件に基づき、裁判所の2020年12月4日の命令に従い、DACAに基づく延期措置の検討に関する要求を受け入れる。
・2017年9月5日より前に有効なDACAの条件に基づき、裁判所の2020年12月4日の命令に従い、DACA更新要求を受け入れる。
・2017年9月5日より前のDACAの条件に基づき、裁判所の2020年12月4日の命令に従い、advance parole documentの申請を受け入れる。
・DACAに基づく延期措置の1年間の付与を2年間に延長する。
・DACAに基づく1年間の雇用許可文書を2年間に延長する。
