2023年度のH-1Bビザ請願を提出するには最初にオンライン登録をし、1登録ごとに10ドルの料金を支払う必要があります。 登録には雇用主と従業員に関する基本情報が必要です。今年は2022年3月1日から3月18日までに登録を提出する必要があります。

登録するときは、pay.govを使用し、1登録ごとにオンラインで10ドルの返金不可の料金を支払う必要があります。 支払い方法は、銀行口座、クレジットカード、デビットカードが使用できます。 この料金は抽選で選ばれた場合、後ほど請願書で支払う申請料金に追加されます。 雇用主は同一人物の同じ登録(重複登録)をすることを禁じられています。 雇用主もしくは担当弁護士が会計年度に同じH-1Bビザ候補者に対して複数の登録を提出した場合、その人物の登録は全て無効になります。 USCISは雇用主とその弁護士が重複登録をチェックできるようにするツールを使用し複数の同じ登録がないか確認します。

抽選と請願
オンライン登録期間後、USCISは受け取った登録からランダムに選定し選択された場合、雇用主または弁護士に通知します。 これは2022年3月31日までに行われます。抽選で選択されたら請願書を提出するための期間が4月1日から90日間あります。選択されなかった場合、順番待ちリストに入り会計年度中にさらにランダムに選択される可能性があります。

今すべきこと
登録期間の前に担当弁護士とミーティングを設定し、H-1Bビザ請願についてH-1Bビザ取得の資格があるかどうかを話し合います。H-1Bビザ請願書を提出するタイミングについても話し合う必要があります。弊社へお問合せする場合は下記をご確認ください。

抽選で選択された場合はUSCISへ提出するものについて、 抽選で選択されていない場合は、他に考えられるオプションについてもここで説明します。

登録日
・2月22日：雇用主はmyUSCISでアカウントの作成を開始できます
・3月1日：オンライン登録期間は東部標準時の正午に始まります
・3月18日：オンライン登録期間は東部標準時の正午に終了します
・3月31日まで：USCISは抽選を実施し選択された登録者に通知します
・4月1日から：抽選で選択された場合、出願期間が開始されます
