FY 2027 H-1B Lottery: What Employers Should Know and How to Prepare Now

The fiscal year 2027 H-1B cap season is approaching. The initial registration period is expected to open in early March 2026 and remain open for at least 14 calendar days.

Below is a quick overview of what employers can expect this season, including the planned introduction of a weighted selection process.

Key Registration Steps

  • Employers (and attorneys, if applicable) must have accounts on myUSCIS.gov.
  • Employers must register electronically and pay a $215 nonrefundable fee per beneficiary (paid online).
  • This $215 registration fee is separate from any other government fees due later if the registration is selected.

Information Typically Needed for Registration

  • Employer name, FEIN, and address
  • Employer representative contact information
  • Attorney information (if represented)
  • Beneficiary full name, date of birth, country of birth/citizenship, gender, passport number
  • Whether the beneficiary has a U.S. master’s degree
  • Wage level information (Level I, II, III, or IV)

Selection Process Highlights

  • Beneficiary-centric selection: each beneficiary gets one chance in the lottery (based on passport/travel document), even if multiple employers submit registrations.
  • Weighted selection (planned for FY 2027): higher wage levels may have better odds of selection than lower wage levels.
    Note: this change may be challenged in court, which could delay or stop implementation.
