米国市民もしくは非市民が米国の会社に米国内で雇用された場合、従業員及び雇用主の両者は、従業員の身元と就労許可の有無を証明するために使用されるフォームI-9の記入を行わなければなりません。

フォームI-9の規定によると、通知の日付から60日間、もしくは国家緊急事態の終了後3営業日以内のいずれか早い方に雇用主が提出することができる、とされています。

・コロナウイルスが原因で自宅待機等で予防措置を講じている従業員がいる雇用主は、3月20日に発表されたフォームI-9の規定によると、ICE(Immigration and Customs Enforcement)のために従業員の身元と雇用許可文書を確認する必要はありませんとされています。

・雇用主は、フォーム内のセクション2のドキュメントをビデオ、メール、Faxなどを使用して検査します。ICEは「セクション2を完了するために3営業日以内にドキュメントのコピーを取得、検査、および保持してください」と述べています。通常業務が再開した後に雇用主は文書を直接検査し、セクションの「追加情報」欄に遅延の理由として「COVID-19」と記入してください。また必要に応じて、セクション３等に記載が必要な場合もあります。

・こういった例外を利用する雇用者は、リモートでの在宅ワークポリシーの書面による文書を各従業員に提供する必要があります。これらはリモートで操作する雇用者と職場にのみ利用可能です。実際に作業場所に従業員がいる場合、この例外は当てはまりません。新しく雇用された従業員または既存の従業員がCOVID-19による隔離、またはロックダウンの対象である場合、米国国土安全保障省（DHS）は必要に応じて申請のアドバイスを行います。
