Family-Based Immigration

There are two types of family-based immigration visas available in the U.S. -- Immediate Relative (IR) and Family Preference (F). Both are based on relationships to Lawful Permanent Residents (LPR).

Immediate Relative (IR)

IR immigrant visas are for individuals who have close family relationships with a U.S. citizen. Family relationships considered "close" in this context include spouses, unmarried children of a U.S. citizen under the age of 21, orphans adopted by U.S. citizens either abroad or in the U.S., or parents of U.S. citizens who are at least 21 years old. There is no limitation on the number of immigrant visas available for those who have an immediate relative relationship to a U.S. citizen.

Family Preference (F)

F immigrant visas are designed for those who have more distant family relationships to a U.S. citizen and those with particular relationships to a Lawful Permanent Resident (LPR). There are several types of Family Preference visas, and Congress restricts the number of visas in each class permitted to be issued in any given fiscal year.

The first preference group consists of unmarried children (over 21 years of age) of U.S. citizens and their minor children. The second preference group comprises spouses, minor children, and unmarried sons and daughters of LPRs. Married sons and daughters of U.S. citizens and their spouses and minor children make up the third preference group. The fourth preference group includes siblings of U.S. citizens and their spouses and children who are under 21 years of age.
