What Is a Writ of Mandamus Lawsuit?

A writ of mandamus is a federal court lawsuit to compel the U.S. government to do an act they legally owe to you. Since Marbury v. Madison in 1803, individuals have had the ability to bring a lawsuit against the U.S. government for failure to act constitutionally.

How Do We Approach Writs of Mandamus?

Since a trial can be expensive and time consuming, our immigration attorneys try to seek a friendly settlement with the USCIS first. We are often able to get results for our clients simply by bringing their issue forward with the agency.

However, sometimes an amicable settlement is not possible. In those cases, clients have little choice but to sue the federal government. When we bring a writ of mandamus lawsuit on behalf of our clients, we understand that it is usually in our clients' best interests to remain on good terms with the USCIS. We will do everything we can to get the best possible result outside of the courtroom.

We will send a demand letter to the U.S. Attorney's Office to ask the U.S. Attorney to convince the agency that they will not win in your case. Our firm's founder, David Nachman is a former U.S. attorney, himself.

If all else fails, we will bring a lawsuit in federal court. We have brought writs of mandamus suits in federal courts throughout the country. Sometimes, we will bring a suit for one client. If multiple clients have the same issue with the USCIS, we will gather a war chest of clients and bring one large lawsuit to persuade the court that there is an ongoing problem.
