多くの方が 11月末から2月中旬までの間、アメリカ国外を旅行します。 この時、税関国境警備局(CBP)への訪問、または、アメリカ領事館への訪問が必要になる場合があります。
弊社のwebsiteでは海外旅行やアメリカ領事館でのビザ取得のについてYouTubeで閲覧できるビデオを投稿していますが、視聴する時間がない場合、国外旅行に伴う不安や帰国問題を緩和するのに役立つ基本的なヒントをお伝えします。
最も重要なことは、全ての方が旅行を許可されているわけではないことを覚えておいてください。 アメリカ、カナダの旅行のルールは事前の通知がほとんどされずに変更されることを覚えておくことが重要です。 アメリカから出国する前に、資格のある移民法専門の弁護士等にご自身の状況を確認することをお勧めします。
旅行しアメリカに再入国する際に必要ないくつかの基本的な文書があります。一緒に旅行するあなたの家族にとっても覚えておくことは重要です。 必要な書類の簡単なチェックリストは次の通りです。
- 出国予定日から少なくとも6か月間有効なパスポート
- 有効なビザ(必要な場合)
- I-797の原本(非移民請願に基づく場合に必要。コピーが受け入れられる場合もあります)
- ステータスを申請中の方は、有効な事前仮釈放旅行書類(または有効なH-1B、H-4またはL-1 / L-2ビザ)(この書類は入国予定時に有効であることを確認してください)
- 永住者の方は、有効な合法永住者カード(グリーンカード)(入国予定時に有効であることを確認してください)
旅行者は入国する際、I-94フォーム(到着/出発記録)を印刷しご持参ください。CBP Webサイトから、http://www.cbp.govにアクセスしご自身のI-94から印刷ができます。旅行する際は、都度I-94を印刷しましょう。 電子I-94のコピーを取得できる唯一の方法は、CBPにFOIAをリクエストすることですが、費用がかかること、またこのリクエストに対して応答を受けるには何週間も時間がかかります。
移民弁護士または弁護士と連絡を取り、母国(または第三国)でビザを申請する必要がある場合は、次の情報の一部を知っておく必要があります。 以下は大使館への訪問にも役立ちます。
- 14歳から79歳までのほとんどの方は大使館での面接が必要です。オンラインでは面接免除ができる特別はルールを確認することできます
- 旅行者の中でも、カナダ、メキシコ、または訪問する可能性のある他の国のアメリカ領事館で第三国処理(TCP)を検討することができます

In Scialabba v. Cuellar de Osorio, a heavily-divided U.S. Supreme Court ruled against thousands of aspiring young immigrants who were included on their parents' visa petitions as minors, but who turned 21-known as "aging-out" before visas became available. Aging-out is tantamount to someone losing his place in the visa line with his parents. In the case, the majority ruled despite having waited his turn in line, the mere fact that the child aged-out means that his time was lost and the case could not be converted into a more appropriate visa category. There have been many cases where the parents got the immigrant visa, but the children became over 21, and therefore, the immigrant visa was denied to them. Some children were lucky and got the immigrant visa with their parents, even after they aged-out, for the reason that they qualified under the Child Status Protection Act (CSPA). Read more . . .

When President Bush signed into law The Child Status Protection Act (CSPA) on August 6, 2002, it was evident that the Act sought to avoid penalizing children for U.S. Citizenship & Immigration Services (USCIS) [formerly known as INS] delays. The CSPA amends the Immigration & Nationality Act (INA) by permitting certain aliens to retain classification as a "child" under the Act, even if he or she has reached the age of 21. However, the CSPA provisions were so ambiguous that USCIS officials and American consular officers had difficulties in interpreting its language and sense. The Department of State (DOS), which interprets matter of law for American consular officers, then provided guidelines and clarifications though several cables to consular officers to enable the proper applicability of CSPA. USCIS also issued instructions to its field officers through several memorandums clarifying the applicability and implementation of CSPA. Read more . . .
